of such owner; and if there is no such agent, the occupier; and for the purposes of this Ordinance, every mortgagee in possession shall be deemed an owner.

(28) "Partition wall" means any wall of the height of one storey only, or of a less height, used or con- structed to be used for separating one part of a building from another part of the same building, and not coming under the definition of cross wall, **external wall", "main wall" or "party wall".

"

(29) Party structure" means a party wall, and also a partition floor or other structure separating, vertically or horizontally, buildings, storeys or rooms which be- long to different owners.

(30) Party wall" means a wall forming part of a building and used or constructed to be used in any part of the height or length of such wall for the separation of adjoining buildings belonging to different owners or occupied or constructed or adapted to ve occupied by different persons.

(31) "Person" includes a body corporate a partner- ship and an association of persons unincorporated.

(32) "Fremises" includes any land, building, or structure of any kind, footway, yard, alley, court, garden, stream, nullah, pond, pool, field, marsh, drain, ditch, or place open, covered or inclosed, cesspool or foreshore, also any vessel lying within the waters of the Colony.

(33) “Public Building" includes any building not in occupation of the Naval or Military Departments, used for public worship, public instruction, public assembly or public recreation; and also any building used as an hotel or as a public hall or hospital, or for any other public purpose whatsoever.

(34) "Room" includes any sub-division

of any storey of any domestic building other than a drying- room, store-room, pantry, lobby or landing which is not used for sleeping purposes.

(35) "Storey" means the space between the upper surface of every floor and the upper surface of the floor next above it or if there be no such upper floor, The space between the upper surface of a floor and the upper surface of the roof, but does not include any space which has a less height than nine feet. In the case of a top storey the space shall be measured from the Hoor up to the underside of the ceiling if the ceiling is horizontal throughout, and if there is no ceiling or if the ceiling is wholly or partly sloping then up to a level half way between the top of the wall and the underside of the uppermost timber of the roof.

(36) "Street" includes the whole or any part of any square, court or alley, highway, lane, road, road-bridge, footpath, or passage whether a thorough- fare or not.

(37) "Tenant" means any person who holds direct from any householder the whole or any part of any floor or floors of any building.

(38) "Tenement-house" means any domestic build- ing constructed, used, or adapted to be used human habitation by more than one tenant.

(39) “Verandah" means any stage, platform, or portico projecting from a main wall of any building and supported by piers or columns.
